Der Volksentscheid über die Annahme der Verfassung fand gleichzeitig mit der Landtagswahl am 1. Dezember 1946 statt. Von den etwa vier Millionen Wahlberechtigten machten 75,7 Prozent von ihrem Stimmrecht Gebrauch. Mit 70,6 Prozent Ja-Stimmen fand die Verfassung eine breite Zustimmung. Am 1. Dezember wird seitdem im Freistaat der Verfassungstag begangen.
Nach der Annahme durch den Volksentscheid fertigte Ministerpräsident Wilhelm Hoegner die Bayerische Verfassung am 2. Dezember 1946 aus. Mit der Verkündung im Gesetz- und Verordnungsblatt trat sie am 8. Dezember 1946 in Kraft. Allerdings fehlt von ihrem Original bis heute jede Spur.
