König Ludwig III. (1845-1921, reg. 1912/13-1918), der sich angesichts der Revolution nach Schloss Anif bei Salzburg geflüchtet hatte, entband am 12. November 1918 die bayerischen Beamten, Offiziere und Soldaten vom dem auf ihn geleisteten Treueid. Die Regierung Eisner publizierte diese Erklärung am 13. November 1918 zusammen mit einer Erläuterung, in der sie vom "Thronverzicht" des Königs Kenntnis nahm. Tatsächlich aber haben weder der König noch Kronprinz Rupprecht (1869-1955) jemals auf ihren Thron verzichtet.
Ludwig III. ergriff daraufhin selbst die Initiative und bestellte am 12. November 1918 Dandl zu sich nach Schloss Anif bei Salzburg, das sich im Besitz des bayerischen Reichsrats Ernst Graf von Moy befand. Während Dandl vom König einen Thronverzicht verlangte, fand sich dieser nur bereit, die Beamten, Offiziere und Soldaten von ihrem Eid auf ihn zu entbinden, da er nicht mehr in der Lage sei, die Regierung weiter zu führen.

Die Regierung Eisner veröffentlichte das Dokument noch am selben Tag zusammen mit einer Erläuterung, der zufolge die Regierung vom "Thronverzicht" Ludwigs Kenntnis nahm.
